Terms and Conditions for Bikaner Vyapar Udhyog Mandal (Chamber of Commerce & Industry Bikaner) Rail Gate App

These Terms and Conditions (“Terms”) govern the use of the Bikaner Vyapar Udhyog Mandal (Chamber of Commerce & Industry Bikaner) Mobile Application (“App”), owned and operated by Bikaner Vyapar Udhyog Mandal (Chamber of Commerce & Industry Bikaner) (“Company,” “we,” “us,” or “our”). By accessing or using the App, you (“User,” “you”) agree to be legally bound by these Terms. If you do not accept any provision of these Terms, you must immediately cease all use of the App.
1. Eligibility and Account Registration
Users must register an account by providing accurate, complete, and up-to-date information. Users are solely responsible for maintaining the confidentiality of login credentials and for all activity conducted under their account.

Pharmacies and Medical Distributors, hereafter referred to collectively as “Business Users”, are required to submit valid business credentials and applicable compliance documentation.

Silent Users: Granted access equivalent to that of Business Users without the obligation to register a physical store. Silent User accounts are available solely under a paid subscription plan.

General Users: Permitted to access publicly available content and features. Account registration is optional but required to utilize certain features.

User Content: By submitting content, Users grant Bikaner Vyapar Udhyog Mandal (Chamber of Commerce & Industry Bikaner)a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute such content in connection with the operation of the App.
2. User Obligations and Conduct
By accessing or using the App, Users agree to:

Provide truthful and lawful information at all times.

Comply with all applicable laws, rules, and regulatory guidelines.

Refrain from engaging in unauthorized, fraudulent, deceptive, or malicious behavior.

Not disrupt or compromise the integrity or security of the App.

Immediately notify the Company of any unauthorized access or breach involving their account.
3. Compliance Document Requirements
Applicable to Business Users:

Required to submit valid compliance documents including, but not limited to, Retail Drug Licenses (RDL) or Wholesale Drug Licenses (WDL).

All submissions are subject to review by the Company. Submission of falsified or invalid documentation may result in immediate account suspension or permanent termination.

Users are solely responsible for maintaining up-to-date compliance status.
4. Privacy and Data Usage
Use of the App constitutes consent to the Company’s collection, use, processing, and disclosure of personal and business data in accordance with the Privacy Policy.

Data Categories: Includes personal details, business documentation, location data (if enabled), usage analytics, and device identifiers.

Purpose: Data is used for authentication, compliance checks, analytics, communication, personalization, and service improvement.

Disclosure to Third Parties: The Company may share user data exclusively with trusted third parties with whom it maintains a collaborative business relationship, including regulators, pharmaceutical partners, technical vendors, and marketing affiliates, solely for legitimate operational, compliance, or business enhancement purposes.
5. Acceptable Use Policy
Users are strictly prohibited from:

Uploading misleading, harmful, or unlawful content.

Exploiting or attacking the App or its infrastructure.

Using bots, scrapers, or unauthorized automated systems.

Violating intellectual property rights of any third party.

Distributing spam, advertisements, or unsolicited content.
Violation may result in immediate suspension or termination of access and may be subject to legal consequences.
6. Informational Nature of Content
All content made available via the App is provided for informational purposes only. While Bikaner Vyapar Udhyog Mandal (Chamber of Commerce & Industry Bikaner) LLP strives to ensure accuracy, no warranties are made regarding the reliability or completeness of information. The Company shall not be held liable for any decisions or actions taken based on App content.
Users are advised to independently verify any content prior to reliance or commercial use.
7. Data Security
The Company employs commercially reasonable administrative, technical, and physical safeguards to protect User data. However, absolute security cannot be guaranteed. Users are responsible for maintaining the confidentiality of their credentials and devices.
8. Notifications and Communication
The App may send Users operational and account-related notifications through various channels including in-App messages, email, SMS, and WhatsApp, depending on the selected subscription plan. Users consent to receive such communications.
9. Subscription Plans and Payment Terms

Premium features require a paid subscription, managed via third-party payment processors.

Subscription charges are non-refundable unless otherwise specified in the Refund & Cancellation Policy.

Subscription plans may vary in scope. Users may cancel or modify their plan via their account settings.

Silent User accounts are restricted to paid subscriptions only.

All features and service offerings are provided at the Company’s sole discretion and may be altered, suspended, or terminated at any time without prior notice.
10. Intellectual Property Rights
All intellectual property, including trademarks, logos, and content presented on the App, belongs exclusively to Bikaner Vyapar Udhyog Mandal (Chamber of Commerce & Industry Bikaner) or its licensors. No User is permitted to reproduce, distribute, or exploit any content without prior written consent.
11. Limitation of Liability
Bikaner Vyapar Udhyog Mandal (Chamber of Commerce & Industry Bikaner) disclaims any and all liability for:

Any inaccuracies, omissions, or delays in the App’s content.

Decisions made or actions taken based on the App’s information.

Technical disruptions or operational failures.

Conduct or content of any third parties or other Users.
12. Account Suspension or Termination
The Company reserves the right to suspend or permanently terminate any account found in violation of these Terms or applicable law. Users may voluntarily delete their account by submitting a written request or using in-app options.
13. Third-Party Content and Links
The App may contain links to third-party websites or content. Bikaner Vyapar Udhyog Mandal (Chamber of Commerce & Industry Bikaner) does not control, endorse, or assume responsibility for external content. Users interact with third-party services at their own risk and must review their terms independently.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed under the laws of India. Disputes shall be resolved exclusively by arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bikaner.
15. Modification of Terms
Bikaner Vyapar Udhyog Mandal (Chamber of Commerce & Industry Bikaner) reserves the right to amend these Terms at any time. Updated versions shall be published within the App. Continued use following any update constitutes acceptance of the revised Terms.
